Convergence: where does this most make sense? Given that the internet is not regulated, there really is very little regulatory convergence between telecomms and broadcasting. Where having a converged regulator most makes sense is with regard to spectrum management. In particular, Ofcom will be very well placed to make the necessary trade-offs between spectrum use for commercial and public interest needs. In addition, ‘convergence’ in the regulatory sense will be helpful for competition matters, especially when considering the market positions of vertically integrated companies like BSkyB, and increasingly, the large telecomms porviders like BT and Vodaphone who are beginning to produce content. Sectoral Expertise likely to diminish in a large organisation with staff working across disciplines rather than having specialised sectoral regulators like the ITC & Rau. B ut will be an advantage for considering competition issues. Accountability requirements the balance, the quid pro quo for Ofcom’s considerable power and independence. It is only by ensuring Ofcom remains accountable to the public, to the industry, and stakeholders can there be safeguards.
