PODMIOT PRAWA W toku ustalania praw dziecka organy władzy publicznej oraz osoby odpowiedzialne za dziecko są obowiązane do wysłuchania i w miarę możliwości uwzględnienia zdania dziecka. (Art. 72 Konstytucji RP z 2 kwietnia 1997 r.) LEGAL SUBJECT Organs of public authority and persons responsible for children, in the course of establishing the rights of a child, shall consider and, insofar as possible, give priority to the views of the child. GODNOŚĆ Przyrodzona i niezbywalna godność człowieka stanowi źródło wolności, praw człowieka i obywatela. Jest ona nienaruszalna, a jej poszanowanie i ochrona jest obowiązkiem władz publicznych. (Art. 30 Konstytucji RP z 2 kwietnia 1997 r.) DIGNITY The inherent and inalienable dignity of the person shall constitute a source of freedoms and rights of persons and citizens. It shall be inviolable. The respect and protection thereof shall be the obligation of public authorities. (Art. 30 The Constitution of the Republic of Poland, of 2nd April, 1997)

RÓWNOŚĆ EQUAL Wszyscy są wobec prawa równi. Wszyscy mają prawo do równego traktowania przez władze publiczne. Nikt nie może być dyskryminowany w życiu politycznym, społecznym lub gospodarczym z jakiejkolwiek przyczyny. (Art. 32 Konstytucji RP z 2 kwietnia 1997 r.) EQUAL All persons shall be equal before the law. All persons shall have the right to equal treatment by public authorities. No one shall be discriminated against in political, social or economic life for any reason whatsoever. (Art. 32 The Constitution of the Republic of Poland, of 2nd April, 1997)

Prawa materialne są to konkretne prawa przysługujące człowiekowi: wolność słowa, sumienia, wyznania, wyboru miejsca pobytu, prawo do nauki itd. Prawa proceduralne są to dostępne człowiekowi sposoby działania i związane z nimi instytucje pozwalające jednostce wyegzekwować od rządzących przestrzeganie wolności i realizację praw. Substantive rights are specific freedoms and rights ascribed to the individual: freedom of speech, conscience, religion, and choice of place of residence, right to education etc. Procedural rights are means of action at the individual's disposal and the related institutions which make it possible for him to demand from the authorities' observance of his freedoms and the enjoyment of his rights.

PRAWA INDYWIDUALNE Prawa człowieka są indywidualne. Ich podmiotem jest pojedynczy człowiek. Nie można więc mówić w obrębie praw człowieka o prawach mniejszości narodowych – to język i domena polityki (takim zbiorowym prawem byłoby np. prawo do autonomii) – lecz o prawach osób należących do mniejszości narodowych. Nie mówimy o prawach inwalidów jako grupy lecz o prawach każdego z nich z osobna. INDIVIDUAL RIGHTS Human rights are individual. Their subject is an individual. Therefore, in the area of human rights we cannot speak of rights of national minorities as this the language and domain of politics ( an example of such collective right being e. g. the right to autonomy), but merely of the rights of persons belonging to national minorities. Similarly, there are no rights of the disabled seen as a group – merely the rights of each disabled person individually.

OGRANICZENIE PRAW CZŁOWIEKA Ograniczenia w zakresie korzystania z konstytucyjnych wolności i praw mogą być ustanawiane tylko w ustawie i tylko wtedy, gdy są konieczne w demokratycznym państwie dla jego bezpieczeństwa lub porządku publicznego, bądź dla ochrony środowiska, zdrowia i moralności publicznej, albo wolności i praw innych osób. Ograniczenia te nie mogą naruszać istoty wolności i praw. (Art. 31 Konstytucji RP z 2 kwietnia 1997 r.) LIMITATION of HUMAN RIGHTS Any limitation upon the exercise of constitutional freedoms and rights may be imposed only by statute, and only when necessary in a democratic state for the protection of its security or public order, or to protect the natural environment, health or public morals, or the freedoms and rights of other persons. Such limitations shall not violate the essence of freedoms and rights. (Art. 31 The Constitution of the Republic of Poland, of 2nd April, 1997)
